Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RacerFly, a service operated by OV Copy, Inc. (“RacerFly,” “we,” “us,” or “our”). By creating an account, uploading content, or otherwise using RacerFly, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

RacerFly is an AI-powered platform for discovering, searching, and clipping grassroots endurance racing video. You may upload race footage, search videos using photos and text, and export clips, subject to the limits of your plan.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use RacerFly. You are responsible for the security of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Your Content

You retain ownership of the videos, images, and other content you upload (“Your Content”). By uploading, you grant RacerFly a worldwide, non-exclusive license to host, store, process, index, generate embeddings and thumbnails from, and display Your Content for the purpose of operating and improving the service. You represent that you have the rights necessary to upload Your Content and that it does not infringe the rights of others or violate any law. You are responsible for the privacy of individuals appearing in footage you upload.

4. Free-Tier Clip Sharing and Attribution

RacerFly’s clip editing tools are offered free of charge on the free tier in exchange for the right to publish the clips you create. When you create a clip from a public video on the free tier, you must affirmatively agree, at the time of creation, that RacerFly may publish that clip publicly — on the RacerFly platform and in our marketing — and may attribute and tag you using the social media handles on your profile. This is why we ask for your socials.

This is a forced opt-in: if you do not agree, you may not use the free-tier clip tools. Your choices are to agree, or to upgrade to Pro. Pro subscribers’ clips are private by default; a Pro subscriber may separately opt in to publish and be tagged on a per-clip basis. By agreeing (free tier) or opting in (Pro), you grant RacerFly a worldwide, non-exclusive, royalty-free license to publish, distribute, display, promote, and tag the clip and your associated handles for as long as the clip remains published.

5. Acceptable Use

You agree not to upload content that is unlawful, infringing, or that you do not have the right to share; not to attempt to disrupt, reverse engineer, or gain unauthorized access to the service; and not to use the service to harass others or to scrape data at scale. We may remove content or suspend accounts that violate these Terms.

6. Subscriptions and Billing

RacerFly offers a free tier and a paid Pro subscription billed monthly or annually through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are shown on our Pricing page and may change with notice for future billing periods.

7. Cancellation and Refund Policy

You may cancel your Pro subscription at any time from your account settings. Cancellation stops future renewals; you retain Pro access through the end of the billing period you have already paid for.

Subscription fees are generally non-refundable, and we do not provide refunds or credits for partial billing periods or unused features. As a courtesy, if you were charged in error or are dissatisfied, contact us at support@racerfly.com within 14 days of the charge and we will review your request in good faith. Where required by applicable law, you may have additional statutory cancellation or refund rights that these Terms do not limit.

8. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that search results, action detection, or AI-generated output will be accurate, complete, or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law, RacerFly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Your continued use after changes take effect constitutes acceptance.

13. Copyright, DMCA, and Reporting Abuse

RacerFly respects intellectual property rights and complies with the Digital Millennium Copyright Act (“DMCA”). If you believe content on RacerFly infringes your copyright, send a written notice to our designated agent at dmca@racerfly.com including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or enough detail to locate the allegedly infringing material; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We will remove or disable access to infringing material expeditiously and may terminate repeat infringers.

To report illegal, abusive, harassing, or otherwise violating videos or comments, use the in-product “Report” control on the item, or email support@racerfly.com. Reports are reviewed by our moderation team, and we may hide or remove reported content and suspend the responsible account.
